These Terms and Conditions (“Agreement”) constitute a legally binding contract between Rettinger Fireplace Systems (“Company,” “we,” “us,” or “our”) and you (“Customer,” “you,” or “your”). By requesting a quote, placing an order, scheduling a service appointment, or otherwise engaging with Rettinger Fireplace Systems, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

If you are entering into this Agreement on behalf of a business or organization, you represent that you have authority to bind that entity to these terms.

Rettinger Fireplace Systems provides the following products and services, subject to availability and applicable codes and regulations:

• Sale and installation of fireplaces, fireplace inserts, wood-burning stoves, gas fireplaces, and electric fireplaces
• Chimney cleaning, inspection, and repair services
• Supply and installation of mantels, surrounds, hearth pads, and related accessories
• Maintenance, repair, and annual service of existing fireplace and heating appliance systems
• Consultation and design services for new fireplace installations

All products are subject to manufacturer availability. We reserve the right to substitute comparable products if a specified product becomes unavailable, with prior notice to the Customer.

All written quotes are valid for thirty (30) days from the date of issue unless otherwise stated. Prices are subject to change after the quote expiration period. Verbal estimates are non-binding.

A deposit of fifty percent (50%) of the total project cost is required to confirm a scheduled installation or service appointment. The remaining balance is due upon completion of work and before our technicians leave the premises, unless alternative arrangements have been agreed to in writing.

We accept the following forms of payment:

• Cash and personal or business checks (payable to Rettinger Fireplace Systems)
• Major credit cards (Visa, MasterCard, American Express, Discover)
• Bank transfer or ACH payment (arrangements must be made in advance)

Returned checks will incur a fee of $45.00. Balances not paid within thirty (30) days of the due date are subject to a finance charge of 1.5% per month (18% annually) on the outstanding balance, plus any costs of collection including reasonable attorney fees.

Appointments are scheduled based on technician availability and geographic service area. Estimated installation timeframes are provided in good faith but are not guaranteed due to factors including product availability, permitting timelines, and weather conditions.

If you need to cancel or reschedule, we require at least forty-eight (48) hours advance notice. Cancellations made with less than 48 hours notice may result in a cancellation fee of up to $150.00. Deposits are non-refundable if work has been ordered or materials have been delivered.

Rettinger Fireplace Systems reserves the right to reschedule appointments due to inclement weather, technician illness, or other unforeseen circumstances. We will notify you as promptly as possible in such cases.

To ensure a safe and efficient installation, the Customer agrees to the following prior to and during service:

• Provide clear and safe access to the installation area, including removal of furniture, valuables, and obstructions
• Ensure an adult (18+) is present for the duration of the appointment
• Disclose any known structural issues, pre-existing conditions, or prior chimney or fireplace damage
• Obtain any necessary homeowner association (HOA) approvals before scheduling installation
• Ensure pets are secured and away from the work area

Additional charges may apply if unforeseen conditions are discovered during installation that require additional materials, labor, or structural modifications. We will notify you before proceeding with any work that materially increases the project cost.

Certain installations require permits from local municipalities or building authorities. Where required, Rettinger Fireplace Systems will obtain the necessary permits on the Customer’s behalf; associated permit fees will be billed to the Customer at cost.

All installations are completed in accordance with applicable local, state, and national building codes, including NFPA 211 (Standard for Chimneys, Fireplaces, Vents, and Solid Fuel-Burning Appliances) and manufacturer installation specifications.

• Labor Warranty: All installation and repair labor is warranted for one (1) year from the date of completion against defects in workmanship.
• Product Warranty: Products are covered by their respective manufacturer warranties. We will assist in facilitating warranty claims with manufacturers on your behalf.
• Chimney Services: Cleaning and inspection services carry a satisfaction guarantee; please contact us within 14 days if you have concerns.

Warranties are void if the product or installation has been altered, misused, improperly maintained, or damaged by events outside our control including fire, flooding, acts of nature, or tampering by third parties.

To the maximum extent permitted by applicable law, Rettinger Fireplace Systems shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of use, lost profits, or property damage not directly caused by our negligence.

Our total liability to you for any claim arising out of or related to products or services provided under this Agreement shall not exceed the total amount paid by you for the specific product or service giving rise to the claim.

Fireplaces, stoves, and chimney systems require proper care and maintenance to operate safely. Rettinger Fireplace Systems strongly recommends:

• Annual chimney inspections and cleanings by a certified chimney sweep
• Use of dry, seasoned hardwood in wood-burning appliances
• Installation and regular testing of carbon monoxide detectors and smoke alarms
• Keeping flammable materials a minimum of 36 inches from the firebox opening
• Never leaving a fire unattended

Rettinger Fireplace Systems is not responsible for damage, injury, or loss arising from failure to follow safety guidelines, manufacturer instructions, or recommended maintenance schedules.

Rettinger Fireplace Systems collects Customer information including name, address, contact details, and payment information solely for the purpose of providing our products and services. We do not sell or share Customer information with unaffiliated third parties for marketing purposes. Information may be shared with third parties as required to complete services (e.g., permit authorities, product manufacturers) or as required by law.

In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If negotiation is unsuccessful within thirty (30) days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, with proceedings held in the county where the services were performed.

Either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.

This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in the State of New Jersey.

Rettinger Fireplace Systems reserves the right to update or modify these Terms and Conditions at any time. Updated terms will be made available on our website and will apply to any orders or appointments confirmed after the effective date of the revision. Continued engagement with our services following notice of changes constitutes your acceptance of the revised terms.

This Agreement, together with any signed proposal or work order, constitutes the entire agreement between the parties and supersedes all prior or contemporaneous understandings, negotiations, representations, and agreements, whether written or oral. Any modification to this Agreement must be in writing and signed by an authorized representative of Rettinger Fireplace Systems.
